LA ACADEMIA DE CIENCIAS POLITICAS Y SOCIALES

La Academia de Ciencias Políticas y Sociales, en su condición de organismo integrado principalmente por profesores de ciencias jurídicas y políticas que han alcanzado los más elevados niveles en el escalafón universitario y que está obligada a expresar opinión sobre los asuntos públicos del más alto interés nacional, quiere expresar su parecer en torno al acto electoral del pasado domingo 14 de abril de 2013:

1. El proceso electoral que culminó el 14 de abril no guarda correspondencia con los criterios internacionales de elecciones libres y democráticas.

2. Las elecciones del día 14 de abril, acto culminante del proceso, estuvieron teñidas por numerosas denuncias de irregularidades –llamados incidentes electorales- por la oposición democrática.

3. Ante el resultado ofrecido por el árbitro electoral, el cual muestra una diferencia mínima en favor del candidato oficial, la oposición ha solicitado un recuento de los votos, cosa que fue aceptada públicamente por el candidato gubernamental la misma noche de la elección. Esta es la fórmula idónea para resolver este tipo de discrepancias. Sin embargo, el árbitro electoral ha negado esta posibilidad y ha procedido apresuradamente a declarar vencedor al candidato oficial y le ha entregado su credencial al día siguiente de las elecciones. Con este proceder se ha creado en el país una delicada crisis política.

4. El argumento principal del árbitro electoral hace privar los aspectos técnicos de emisión, transmisión y resguardo electrónico del voto sobre los soportes físicos de la “papeleta electoral” o boleta consignada en las cajas o urnas electorales. Esta posición es contraria a los principios generales y universales de interpretación del derecho de las nuevas tecnologías, el cual ha consagrado el principio de equivalencia funcional –recogido en la Ley sobre Mensajes de Datos y Firmas Electrónicas- para indicar que el registro informático surte los mismos efectos que el registro físico. Sin embargo, esa equivalencia funcional no implica que, en el supuesto que haya un respaldo material físico del registro electrónico, el material físico quede sustituido íntegramente por el electrónico. Al contrario, cuando se presenta una discrepancia entre un documento elaborado en forma física y su soporte electrónico, la discrepancia se resuelve acudiendo a los originales contenidos en el formato físico. Eso es lo que hay que hacer en el caso de la discrepancia de cifras electorales que tienen los candidatos: ir, entre otros, a “las papeletas” o boleta consignada, es decir, ir a los soportes físicos materiales originales. Afirmar, como lo hizo la Presidenta del árbitro colectivo electoral, que tal cosa sería regresar al antiguo sistema de conteo de papeletas es desconocer que la papeleta o boleta consignada sigue siendo parte del sistema electoral venezolano. Tan cierto es lo dicho que, la Ley orgánica de procesos electorales se refiere expresamente y exige considerar la papeleta o boleta de consignada como elemento de prueba de las posibles inconsistencias que pueden justificar la nulidad del acta de escrutinio (art. 219). Adicionalmente, se le encomienda a la Fuerza Armada Nacional Bolivariana su custodia, traslado y resguardo. Si la papeleta fuera un elemento inútil o inservible que más nunca va a ser utilizado con propósito alguno sería un despropósito que sirva de elemento de convicción ante una eventual verificación de inconsistencias o encomendar su custodia a la autoridad militar. Tan importante es la papeleta, además, que la verificación ciudadana que se realiza al finalizar el escrutinio de los votos, se lleva a cabo leyendo cada una de ellas, registrando el nombre que en ella aparece, tomando nota del total de todas ellas y contrastando su número con los datos del cuaderno de votación. Todos estos actos demuestran que el legislador se inclinó por darle preferencia a la prueba material por encima de la prueba virtual, respetando, de esa manera, los preceptos constitucionales que regulan el derecho de la prueba.

5. El problema planteado por los ajustados resultados electorales del 14 de abril es un gravísimo asunto político que debe recibir una inmediata solución política. Sin embargo, cuando los asuntos políticos se mueven en los extremos de la dimensión jurídica, la tendencia predominante en los países con ordenamientos jurídicos democráticos es ofrecer al débil jurídico, al integrante de la minoría o al aparentemente derrotado, vías a través de las cuales se pueda canalizar pacíficamente su insatisfacción. El recuento de los votos, junto a las protestas y a las manifestaciones pacíficas, es uno de los medios legítimos de la convivencia democrática. Negarlos es cerrar una vía de escape al desacuerdo. Referir a los opositores al ejercicio de recursos ante los órganos jurisdiccionales no es la solución más efectiva acorde con la situación jurídica y política planteada.

6. Finalmente, en Venezuela está garantizado el derecho de todo ciudadano a expresar democráticamente su opinión política en las urnas electorales y a reclamar su defensa. Constituirían violaciones de los derechos humanos la amenaza o el uso de la violencia civil o de Estado como recurso inmediato contra los reclamos legítimos de una población indefensa.

Capriles Radonski: “Ya fue impugnada en forma total la elección del 14-A”

Fueron las palabras en la cuenta de Twitter (@hcapriles) del ex candidato a la presidencia de Venezuela y actual gobernador del estado Miranda, Henrique Capriles Radonski la noche del jueves 2 de mayo, quien, a través de abogados, presentó la denuncia ante el Tribunal Supremo de Justicia venezolano. A la víspera de tan esperado anuncio, y a miles de kilómetros de distancia, pero como si estuvieran en su país natal, la noche del miércoles se reunían en Café Canela un grupo de venezolanos con el Comando Simón Bolívar de Weston, FL, para escuchar de la boca de varios entendidos qué significa esta impugnación y por qué la oposición alega fraude electoral.

Los anfitriones, Ramón Peraza de Café Canela y Oscar Ganem, del Comando Simón Bolívar de Weston, dieron la bienvenida a un variopinto grupo de expositores, que incluían desde una tía de Capriles, la señora Alicia Rivero, hasta Carlos García, quien presentó un análisis estadístico exhaustivo del presunto fraude electoral. “Estamos con nuestros cuerpos aquí, pero nuestras almas están allá. Los venezolanos aquí en Miami somos venezolanos al 200%” expresó Rivero, quien tiene seis años viviendo en Estados Unidos. Pero el plato fuerte de la noche fue la participación de dos co-protagonistas de la bancada opositora: la ex Rectora del Consejo Nacional Electoral, Ana Díaz, y el ex Presidente de Fedecámaras y empresario, Carlos Fernández, con casi una década en el exilio.

Muchos recuerdan a Díaz por la célebre frase que pronunció el 2 de marzo de 2004, que le costó su puesto como rectora del organismo electoral venezolano: “Las firmas están, son suficientes y vamos al (referendo) revocatorio”. Acto seguido, recibió una carta de despido de la Presidencia de la República, entonces en manos de Hugo Chávez Frías, “por no ser de confianza”, dijo. Otros tienen recuerdos más recientes de ella, debido a su participación en el programa de Jaime Bayly por Mega TV, pocos días antes de las elecciones del pasado 14 de Abril. Para ella, muchos venezolanos tomaron conciencia gracias a este programa, fueron a votar y regresaron a los centros electorales para defender su voto. “Nosotros en el exterior somos la caja de resonancia de los que están allá”, afirmó, agregando que “este es un régimen Castro-comunista y ellos creen que llegaron para quedarse. Pero Venezuela es nuestra, de los venezolanos.”

“Esta es una guerra comunicacional y quienes estamos en el extranjero jugamos un papel clave”, dijo Fernández al dirigirse a los asistentes. Para el empresario, a la par de la resistencia política, los venezolanos deben prepararse para una escasez de alimentos y medicinas aun más grave que la actual. “La situación económica del país es muy complicada y hará que caiga el castillo de naipes sobre el cual esta montado Nicolás Maduro.” Según Fernández, el régimen ha entrenado a mas de dos millones de personas en Cuba para arremeter contra el pueblo venezolano, junto a cubanos y guerrilleros de las FARC uniformados como fuerzas del orden criollas. “Ellos saben que la única manera de imponerse es por la violencia, pero nosotros no podemos caer en la violencia.” También condenó la golpiza en la Asamblea Nacional esta semana, donde resultaron heridos media docena de diputados opositores. “Qué más fascismo que lo que sucedió ayer en la Asamblea Nacional, donde los diputados no pueden defender ni la posición de quienes votaron por ellos. Pero nosotros no podemos caer en el juego de la mortandad.”

Para Carlos García, la presunta trampa electoral se concentra en las mesas 1 y 2, particularmente en unos ocho mil centros electorales que cuentan con una sola mesa, ubicados en lugares inhóspitos, donde Maduro, contradiciendo la tendencia estadística en el resto de las mesas del país, sacó el 100% de los votos, en algunos casos con casi 500% de los votos que obtuviera Chávez en las elecciones del pasado 7 de Octubre, algo que, ni siquiera algunos chavistas, pueden aceptar. Según García, algunos de estos centros estaban controlados por guerrilleros de las FARC y Tupamaros, así como militares afectos al régimen y “esbirros” cuya única función era amedrentar a los electores y meterles miedo al votar, y al tratar de defender sus votos. Entre las más de cinco mil irregularidades que denuncian, también figuran el voto asistido, proselitismo político en los centros electorales (lo cual está prohibido por la ley), el uso indiscriminado de los medios de comunicación y recursos del estado para campañas oficialistas, la compra de votos, y el fraude continuado durante jornadas electorales desde 2004.

“El CNE propone una auditoría “chimba” (deficiente), sin revisar los cuadernos electorales. De todos modos, el Comando Simón Bolívar tiene suficientes evidencias de fraude”, agregó García. Sin embargo, “no hay que crearse falsas ilusiones. La auditoría no será favorable a nosotros”, agregó el General Retirado y ex Ministro de la Defensa de Venezuela, Vicente Narváez Churión, denunciando que, según él, los poderes están secuestrados a favor del oficialismo.

A pesar de este sombrío escenario, Fernández confirmó que la bancada opositora seguirá adelante con el proceso de denuncia: “No debemos adelantarnos a los hechos. Vayamos a las instancias que tenemos que ir. No queremos violencia; queremos derrotarlos con las vías legales: la constitución y la auto-determinación de los pueblos, protegida por la comunidad internacional. No hay que decir mucho cuando un país como Estados Unidos se echa para atrás y no reconoce el gobierno de Maduro.”

“Lo mas importante de lo que está sucediendo ahorita es que los venezolanos entendimos que no hay autoridad, no hay democracia en Venezuela”, agregó Ana Díaz para concluir, pero insistió: “Se acabó el miedo. Yo les voy a decir algo: este es el momento de dejar el pellejo por el país. Si nos dejamos vencer por el miedo, perdemos a Venezuela.”

PENSACOLA–Today, Governor Rick Scott announced that the Deepwater Horizon Natural Resource Damage Assessment Trustees have proposed $58 million in early restoration projects for Florida. To date, Phases I and II of early restoration projects for Florida have totaled $11.4 million.

Governor Scott said, “We’re committed to restoring the environment and economy that families have relied upon in the Gulf for generations. These $58 million in Florida projects represent a critical step forward in recovering from the natural resource and recreational losses that resulted from the BP oil spill. We will continue to work with our state, federal and local partners toward solutions that ensure impacted areas are revitalized for families.”

Florida’s Proposed NRDA Phase III Projects: Approximately $58 million

• Florida Gulf Coast Marine Fisheries Hatchery/ Enhancement Center, Escambia County. Approximately $20 million

These projects, if successfully finalized after public review and comment, are in addition to the seven projects, on which Florida has been working, including several boat ramps, a dune restoration project and projects to protect and restore shorebird and sea turtle nesting habitat. With the additional projects, Florida will have allocated nearly $69 million of the $100 million available through the early restoration process defined in the April 2011 Framework Agreement between BP and the Trustees.

The Trustees intend to propose the early restoration projects using a method similar to previous draft restoration plans in order to continue the process of using early restoration funding to restore natural resources, ecological services and human use services injured or lost as a result of the Deepwater Horizon oil spill disaster.

This next set of projects includes many of the proposals that citizens have been suggesting, such as oyster and scallop restoration, seagrass restoration, artificial reefs, living shorelines, recreational beach restoration, state park improvements, and a hatchery project which will help restore the fisheries in north Florida as well as provide much needed research into the area of fisheries management and restoration.

The Trustees have worked to develop and negotiate the 28 proposed projects Gulf-wide, of which 12 are being proposed by Florida.
